To let this clear, pepe wasn't banned because of the foul (it would have probally been just a free kick, or most dramatic a yellow card) but because of the agressive action. It was a dive but it was a foul too. This the problem, if you are fouled and do not dive or actually fall over, the ref doesn't give the foul. If you dive and it is a foul, it's ok. If you dive for no reason, then you should be booked.
